1.About these terms
These Terms of Use (“Terms”) are a legally binding agreement between you and 2XP Pte. Ltd. (UEN 202444839N), which operates HoopersHub in partnership with Unicomi Pte. Ltd. (“we”, “our”, “us”). They govern your use of sg.hoopershub.net, every league and team site on a hoopershub.net address, and the HoopersHub app (together, the “Service”).
By creating an account, ticking to accept, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Under Singapore’s Electronic Transactions Act 2010, this agreement is formed electronically, your electronic acceptance has the same effect as a signature, and we may keep electronic records of it as evidence.
2.The Service
HoopersHub runs basketball competitions and teams from start to finish:
- Organisers run leagues, seasons, divisions and tournaments: registration, eligibility checks, scheduling, officials, standings and playoffs.
- Team and academy managers manage teams, rosters, lineups, staff and programmes.
- Table officials record live statistics during games.
- Players keep one profile, with their games, statistics and achievements, across every competition they play in.
- Parents and guardians manage their children’s profiles through the Family Portal.
- Fans follow leagues, teams, players and live games.
We may change, suspend or discontinue any part of the Service. Where a change materially affects a competition in progress, we will tell its organiser first.
3.Who can use it
- 18 and over: you may create an account and use the Service yourself.
- 13 to 17: you may create an account with your parent’s or guardian’s awareness. They are responsible for your use of the Service.
- Under 13: a parent or guardian must create and manage your profile through the Family Portal.
You must give your real age, and you must not be barred from using the Service under Singapore law. A parent or guardian who lets a child use the Service agrees to these Terms on the child’s behalf, is responsible for the child’s use of it, and consents to the use of the child’s personal data as our Privacy Policy describes.
4.Your account
- Give accurate, current and complete information, and keep it up to date.
- Keep your password secure, and do not share your account.
- Tell us straight away if you think someone else has used your account.
- You are responsible for everything done through your account.
- If you sign in with Google, Google’s terms also apply to that sign-in.
We may suspend or close an account that breaks these rules.
5.Roles and responsibilities
Organisers
If you run a competition on the Service, you are responsible for:
- its rules, its conduct, and the accuracy of its results
- having the right to collect, use and publish the data you enter, and the consents this needs, including a parent’s or guardian’s consent for each child
- asking for identity documents only where the competition’s eligibility rules need them
Where you have a separate written agreement with us, that agreement governs your competition wherever it differs from these Terms.
Clubs and team managers
You register teams, manage rosters and invite players. Before you add a player, you must have that player’s consent, or a parent’s or guardian’s consent for a child. When you sign a competition declaration, you confirm that what it states is true.
Academy managers
You are responsible for accurate programme information and for safe training environments.
Table officials
You record the games you are assigned to, accurately and as they happen.
Players, parents and guardians
You manage your own profile, or your child’s: its details, its privacy settings, and which invitations to accept.
6.Competition records and public pages
Game statistics recorded by officials become part of the competition’s permanent historical record. Organisers choose what their competition publishes, including live scores and play-by-play. Your privacy settings control what else appears on your profile, but they do not remove you from a competition’s published results. You can ask for a record to be taken out of public view, and we will act on reasonable requests together with the organiser.
7.Fees and payment
- Players, parents, guardians and fans use the Service free.
- Organisers pay a fee for each team entered in a competition. The fee is shown before the competition opens for registration, or set in a separate agreement with us.
- Some features, such as academy management, are paid subscriptions.
- Prices are in Singapore dollars and exclude Goods and Services Tax at the prevailing rate. We give at least 30 days’ notice of any price change.
- Card payments are processed by Stripe. We never receive or store your full card details, and an order is confirmed only once payment succeeds.
Subscriptions
- Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time in your account settings, and keep access until the end of the period you have paid for.
- Fees for a billing period that has started are not refunded, except where the law requires.
- If a technical problem stops you from using a paid feature, contact us within 7 days. We may offer a credit or a refund.
- If we close your account without cause, we refund the unused part of your subscription, pro rata.
8.Your content and ownership
- Your content is yours: your profile details, photos and posts, and your child’s, belong to you.
- Competition records belong to the organiser: fixtures, results and statistics are the organiser’s records. Claiming a profile gives you control of that profile, not of a competition’s results.
- Licence: you give us a non-exclusive, royalty-free licence to host, display and distribute the content you submit, only to operate and improve the Service.
You are responsible for what you submit, and it must not infringe anyone’s rights or break the law.
9.Acceptable use
Use the Service with respect and good sportsmanship. You must not:
- break the law, or use the Service for an unlawful purpose
- impersonate anyone, or falsely claim a connection with a person, team or organisation
- submit false information, or create fake players, statistics or results
- manipulate game results or standings
- harass, bully or intimidate anyone, or post defamatory, obscene or offensive content
- try to access any part of the Service, or anyone’s data, without permission, or get around its security or access controls
- interfere with or disrupt the Service or its servers
- scrape or harvest data, or access the Service with bots or automated tools, without our permission
- reverse engineer the Service, or try to extract its source code
- use the Service commercially without our authorisation
10.Intellectual property
The Service, including its design, features, software and branding, belongs to 2XP Pte. Ltd. and is protected by intellectual property law. You may use the Service for your personal use or your organisation’s internal purposes. You may not copy, modify or distribute it, create derivative works from it, or use our name, logo or branding without our permission.
11.Third-party services
The Service works with third-party services, including Google sign-in, Stripe payments, and social media accounts you choose to connect. Their own terms and privacy policies apply when you use them, and we are not responsible for their services or content.
12.Your rights as a consumer
If you are a consumer in Singapore, you have rights under the Consumer Protection (Fair Trading) Act 2003 and other laws, and nothing in these Terms takes them away. We will describe our services and prices accurately, honour advertised prices and promotions, and handle complaints fairly.
If you have a complaint, contact us first at [email protected]. If we cannot resolve it, you can go to the Consumers Association of Singapore (CASE), the Small Claims Tribunals (for claims up to S$20,000), or the Competition and Consumer Commission of Singapore.
13.Disclaimers
Subject to your statutory rights, including under the Consumer Protection (Fair Trading) Act and the Unfair Contract Terms Act, the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or completely secure. We do not guarantee the accuracy of content entered by users, including statistics, results and profile information.
Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot be excluded under Singapore law.
14.Limitation of liability
Subject to section 13, and as far as Singapore law allows:
- we are not liable for indirect, incidental, special, consequential or punitive loss
- our total liability to you is limited to what you paid us in the 12 months before the claim
- we are not liable for what other users do, or for harm arising from their content
- we are not responsible for injuries at basketball activities organised through the Service. Those activities are run by their organisers.
15.Indemnity
You agree to indemnify 2XP Pte. Ltd., its officers, directors, employees and agents against claims, losses and costs, including legal fees, arising from your use of the Service, your breach of these Terms, your infringement of anyone’s rights, or content you submit.
16.Suspension and termination
We may suspend or close your account if you break these Terms, if the law requires it, or if we need to protect the Service or its users. We may also close an account for any other reason, with reasonable notice.
You can close your account at any time in your account settings, or by contacting us. When an account closes, you can no longer use the Service, and any amounts you owe remain due. The sections that by their nature should survive, such as intellectual property, disclaimers and liability, continue to apply.
17.Disputes and governing law
These Terms are governed by the laws of Singapore. If a dispute arises, we will first try to resolve it with you in good faith, then through mediation in Singapore. If it is still unresolved, it goes to the courts of Singapore, which have exclusive jurisdiction.
18.Changes to these terms
We will post any update here and change the date at the top of this page. For a material change, we will also tell you by email or in the Service before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree with them, stop using the Service.
19.General
If any part of these Terms is found invalid or unenforceable, it will be changed only as far as needed to make it valid, and the rest continues in full effect. These Terms, our Privacy Policy, and any separate written agreement you have with us are the whole agreement between you and us about the Service.
